What is the statute of limitations for personal injury claims?
You have been in accident and injured yourself.
No need to rush off to a lawyer because you need to get back on your feet and back to normal life.
But wait!!!!! You need to pay attention. In the law, there is something called a statue of limitations.
The general rule is that you have to start your claim within 2 years of the time you knew that you were injured by another person.
There are some exception to this general rule. If the injured person is under 18, the 2 years begins to run from the time the individual turns 18.
If the injured person cannot make decision for themselves, the 2 years begins to run from the time when soneone is appointed to make decisions.
And lastly, to make it even more confusing, if youhave been injured and it is more than 2 years since the injury, speak to a lawyer to determine if the limitation period may be extended by law. The discoverability rule might apply and extend the time.
Todays’ lesson, speak to us to determine if you can still bring a claim.
