There are a variety of ways a medical provider’s negligence or incompetence can cause or contribute to one of these injuries:

  • Improper testing or evaluation of tests – During a pregnancy, standard tests are used to screen for conditions such as spina bifida (a failure of the vertebrae to enclose the nerves around the spine). Poor management of maternal or fetal health can also lead to problems. For example, brain damage may occur due to placental insufficiency (lack of oxygen and nutrients from a damaged placenta or a placenta that fails grow to sustain a fetus) or maternal or in utero infection. These conditions must be diagnosed and treated in a timely manner.
  • Delayed delivery or traumatic birth – If labour is lengthy a baby may experience fetal distress. Often indicated by fetal tachycardia (abnormally fast heart rate) or the presence of meconium (first fecal matter) in amniotic fluid, fetal distress may lead to perinatal asphyxia (oxygen deprivation) that causes brain damage. Prolonged labour may also increase the risk of shoulder dystocia (where a baby’s head is delivered but the shoulders remain lodged behind the woman’s pelvic bone) and brachial plexus injuries. Poorly handled forced extractions can also cause fractures, soft tissue damage, and serious spinal cord damage or brain injuries.
  • Poor postpartum care – A newborn must be closely monitored following birth to reduce the risk of other birth injuries. For example, jaundice is a common condition for many babies that usually resolves on its own or with minimal intervention. However, if severe jaundice is left untreated or treatment is delayed, it can lead to a condition called kernicterus that results in serious brain injury.
  • Debilitating pain from nerve damage, disability from conditions such as Cerebral Palsy or paraplegia, or disfigurement from birth trauma – a birth injury can change the course of a life forever.
