  $1,000,000 JUDGEMENT IN

FIBROMYALGIA / CHRONIC PAIN DISORDER CASE  

On May 5, 2009, Adam K. Wagman of HSH, along with George Pappas, obtained a significant result for their client in a jury trial in Toronto. They obtained an award of almost $1,000,000 for their client as a result of the injuries and damages she sustained in a motor vehicle accident on February 13, 2003.

The client initially suffered soft tissue injuries to her neck and back as a result of a rear end collision. The injuries did not resolve with treatment and the client eventually developed symptoms of chronic pain, as well as depression. She was diagnosed by a Rheumatologist with fibromyalgia and by a Psychiatrist with a chronic pain disorder. Experts for the Defendants suggested that her symptoms were not serious and that her problems were not related to the accident in question.

At the time of the accident, the client was unemployed but had previously developed a career in IT sales. Due to her chronic pain and fibromyalgia, she was precluded from participating in her pre-accident activities and employment. Her social life disappeared and she could no longer play golf or tennis. The client made numerous unsuccessful attempts to return to work in the IT field. She was able to volunteer at a church, but only for a few hours per month.

As evidenced by the size of the award, the jury accepted that her fibromyalgia and chronic pain disorder were related to the accident, and that she was going to sustain a significant loss of income into the future. The result was a very significant victory for this client.
