Doctor Found Negligent for Failing to Diagnose Spinal Epidural Abcess; $1.5 million awarded in damages and interest.

On January 15, 2007, Neil Sacks and Howard Blitstein commenced a 5 week medical malpractice trial in St. Catharines on behalf of the plaintiffs. The plaintiff, Talal Hamasni, alleged that the defendant, Dr. R. Nagai, failed to diagnose a spinal epidural abscess that formed as a result of an epidural inserted three months prior to treat pain from broken ribs sustained in a motor vehicle accident. The plaintiff suffered from near complete paralysis of his lower extremities for a period of a few months following the eventual diagnosis and surgery. After great efforts at recovery he was left with a permanent neurological deficit in his left leg but was able to mobilize independently.

Unfortunately, as a result of the late diagnosis, subsequent surgery and extended recovery, the plaintiffs’ family business began to fail resulting in its sale three years after the events in question.

Justice John Crane awarded nearly 1.5 million dollars in damages and pre-judgment interest to the plaintiffs.

The decision of Justice Crane was released on April 10, 2007.

The decision is currently under appeal.
